Our client was a sub-contractor working on a scaffold on a large residential construction site, when the scaffold plank he was standing on brake causing him to fall approximately six feet to the ground. Despite the relatively short fall, our client sustained a fracture of his thoracic spine that left him paralyzed from the waist down. In addition to an inability to use his legs, our client also suffers from urinary and bowel issues that will require lifetime medical care.
Through the use of various experts, we were able to argue that the scaffold and the plank were defective and should have been detected by the General Contractor on the job site. We argued that his failure to recognize the dangerous condition was the proximate cause of our client’s injuries.
This case settled on the first day of trial for $7 million. While our client would not trade the use of his legs for any amount of money, the settlement will allow him to live comfortably for the rest of his life and ensures that he can get the best medical care available.
